These Terms of Service ("Terms") govern your access to and use of the GymHQ platform. By creating an account or using GymHQ, you agree to these Terms.

1. About GymHQ

GymHQ is a software platform that enables gyms to manage memberships, attendance, payments, communication, access control, and related fitness services. GymHQ is not itself a fitness center or gym operator.

2. Eligibility

You must:

• be at least 18 years old; or
• have the consent of a parent or legal guardian if under 18.

By using GymHQ, you represent that the information you provide is accurate.

3. Your Account

You are responsible for:

• maintaining the confidentiality of your password;
• safeguarding your account credentials;
• all activities conducted through your account.

You must notify us immediately if you suspect unauthorized access.

4. Memberships

GymHQ manages memberships on behalf of participating gyms. Each gym independently determines:

• membership pricing;
• membership duration;
• cancellation policies;
• suspension policies;
• refund policies;
• class availability;
• operating hours.

GymHQ does not control these policies.

5. Payments

Membership fees are paid to your gym through licensed payment providers integrated into GymHQ. Payment processing is subject to the terms of those payment providers. GymHQ does not store your payment card information.

6. Bluetooth Access and Attendance

Where supported, GymHQ may use Bluetooth technology or similar access-control technologies to:

• verify your presence;
• record attendance;
• enable authorized gym entry.

Users must not attempt to bypass or interfere with these systems.

7. Acceptable Use

You agree not to:

• misuse the platform;
• impersonate another person;
• access another user's account;
• interfere with platform security;
• upload malicious software;
• reverse engineer the platform;
• attempt unauthorized access to data;
• use GymHQ for unlawful purposes.

8. Intellectual Property

GymHQ, including its software, logos, trademarks, graphics, and content, remains the exclusive property of GymHQ or its licensors. You may not copy, modify, distribute, or reproduce any part of the platform without written permission.

9. Availability

We aim to provide reliable service but do not guarantee uninterrupted availability. The platform may occasionally be unavailable due to:

• maintenance;
• software updates;
• technical issues;
• network failures;
• circumstances beyond our reasonable control.

10. Suspension and Termination

We may suspend or terminate your account if you:

• violate these Terms;
• engage in fraudulent activity;
• misuse the platform;
• compromise platform security.

You may close your account at any time. Termination may not automatically cancel obligations owed to your gym.

11. Disclaimers

GymHQ provides technology that assists gyms in managing memberships and operations. GymHQ does not:

• own or operate gyms;
• guarantee the quality of gym facilities;
• supervise trainers;
• provide medical advice;
• guarantee fitness outcomes.

Members participate in fitness activities at their own risk and should consult qualified healthcare professionals before beginning any exercise program.

12. Limitation of Liability

To the maximum extent permitted by law, GymHQ shall not be liable for:

• injuries sustained at any gym;
• disputes between members and gyms;
• interruptions caused by third-party providers;
• indirect, incidental, special, or consequential damages;
• loss of profits, business opportunities, or data.

Nothing in these Terms limits liability that cannot legally be excluded under applicable law.

13. Indemnity

You agree to indemnify and hold GymHQ, its officers, employees, and affiliates harmless from claims, liabilities, damages, and expenses arising from your misuse of the Services or your breach of these Terms.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms shall be subject to the jurisdiction of the competent courts in Nigeria unless otherwise required by applicable law.

15. Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated through the app, website, or email. Continued use of GymHQ following such changes constitutes acceptance of the revised Terms.
